Terms of Service

These Terms of Service govern the relationship between FlyFox Commerce ("we", "us", or "our") and our clients. By engaging our services, you agree to these terms. Specific engagements may be further defined in a separate Statement of Work or Service Agreement.
Services
FlyFox Commerce provides frontend engineering, commerce development, performance optimisation, and technical consulting services. All work is delivered under a separate Statement of Work (SOW) or Service Agreement that defines scope, deliverables, timeline, and fees for each engagement.
Intellectual Property
Upon full payment, FlyFox assigns all intellectual property rights for deliverables specified in the SOW to the client. FlyFox retains the right to use any general methodologies, tools, and know-how developed during the engagement, provided no client confidential information is disclosed.
Confidentiality
Both parties agree to keep confidential any proprietary information shared during the engagement. This obligation survives termination of the agreement. FlyFox will not disclose client information without prior written consent, except as required by law.
Limitation of Liability
FlyFox liability is limited to the total fees paid for the specific engagement giving rise to the claim. FlyFox is not liable for indirect, incidental, or consequential damages, including lost revenue or business interruption, even if advised of the possibility of such damages.
Termination
Either party may terminate an engagement with written notice as specified in the SOW. Upon termination, the client pays for all work completed up to the termination date. Confidentiality obligations and IP provisions survive termination.
